Ana Laura Nettel - 2008 - Problema. Anuario de Filosofía y Teoria Del Derecho 1 (2):431-447.
The idea that guides this paper is that visual images of law have contributed in a very important way to the creation of a mental image of law that supports the belief in an obligation to obey the law. My purpose is: first, to identify and to analyse the visual representation of law and the messages they convey. Second, attempt to find out how they shape the mental image we have of law by following the construction of judicial space and, (...)

  2. Persuasive Argumentation Versus Manipulation.Ana Laura Nettel & Georges Roque - 2012 - Argumentation 26 (1):55-69.
This article deals with the relationship between argumentation and persuasion. It defends the idea that these two concepts are not as opposed as all too often said. If it is important to recognize their differences (there are argumentative discourses without persuasion and persuasive discourses without argumentation), there is nevertheless an overlap, in which characteristics are taken from both. We propose to call this overlap “persuasive argumentation”. In order to bridge argumentation and persuasion, we will first distinguish the latter from manipulation. (...)

BackgroundInformation and communication technology solutions have the potential to support active and healthy aging and improve monitoring and treatment outcomes. To make such solutions acceptable, all stakeholders must be involved in the requirements elicitation process. Due to the COVID-19 situation, alternative approaches to commonly used face-to-face methods must often be used. One aim of the current article is to share a unique experience from the Pharaon project where due to the COVID-19 outbreak alternative elicitation methods were used. In addition, an (...)

Preprints in times of COVID19: the time is ripe for agreeing on terminology and good practices.Paul N. Newton, Tammy Hoffmann, E. Bottieau, Peter W. Zaman, Céline Caillet & Raffaella Ravinetto - 2021 - BMC Medical Ethics 22 (1):1-5.
Over recent years, the research community has been increasingly using preprint servers to share manuscripts that are not yet peer-reviewed. Even if it enables quick dissemination of research findings, this practice raises several challenges in publication ethics and integrity. In particular, preprints have become an important source of information for stakeholders interested in COVID19 research developments, including traditional media, social media, and policy makers. Despite caveats about their nature, many users can still confuse pre-prints with peer-reviewed manuscripts. If unconfirmed but (...)

Aristotle on Ontological Priority in the Categories.Ana Laura Edelhoff - 2020 - Cambridge University Press.
The main objective of this Element is to reconstruct Aristotle's view on the nature of ontological priority in the Categories. Over the last three decades, investigations into ontological dependence and priority have become a major concern in contemporary metaphysics. Many see Aristotle as the originator of these discussions and, as a consequence, there is considerable interest in his own account of ontological dependence. In light of the renewed interest in Aristotelian metaphysics, it will be worthwhile - both historically and systematically (...)

It addresses the current oversight of the educational environment not keeping pace with rapid advances in technology, despite the fact that educating students to engage critically and compassionately with others via online media is of the utmost importance. -/- D’Olimpio claims that philosophical thinking skills support the adoption of an attitude she calls critical perspectivism, (...)

Each action, each thought is accompanied by one’s own breathing. To breathe is always thought of as an individual act. It is one’s own breathing that keeps us alive and it is one’s own breathing that leaves at the moment of death. Up until recently, it was uncommon to talk about breathing as a shared act, as a relational moment that is created with someone else. Yet, Luce Irigaray’s work calls for the cultivation of breathing to enable our ethical coexistence (...)

The Role of Prāṇa in Sāṃkhya Discipline for Freedom.Ana Laura Funes Maderey - 2021 - Journal of Indian Philosophy 49 (1):81-103.
Classical Sāṃkhya has usually been interpreted as an intellectualist school. Its presumed method for the attainment of liberation is essentially characterized by rational inquiry into reality, which involves the intellectual understanding of the distinction between two principles: the conscious and the material. Some have argued that this liberating process is not only theoretical, but that it entails yogic practice, or that it is the natural outcome of existential forces that tend toward freedom. However, recent studies in Sāṃkhya involving detailed analysis (...)

A trusting society allows people to feel safe, communicate with each other and engage with those who are different to themselves without feeling fearful. Social media is a key player in contemporary political, cultural and ethical debates. Given much of online engagement is characterised by impulsive and emotive responses, and social media platforms encourage a form of sensationalism that promotes epistemic vices, this paper explores whether there is space online for moral responses. This paper defends the need for moral engagement with online information and others, using an attitude entitled ‘critical perspectivism’. There is a debate within philosophy of literature as to whether narrative artworks should be judged morally, for their ethical value, meaning and impact. On one side you have the aesthetes, defenders of aestheticism, who deny the ethical value of an artwork can be taken into consideration when judging the work’s overall aesthetic value. Richard Posner backs artists such as Oscar Wilde who famously wrote, ‘there is no such thing as a moral or an immoral book. Books are well written, (...)

Following neo-Aristotelians Alasdair MacIntyre and Martha Nussbaum, we claim that humans are story-telling animals who learn from the stories of diverse others. Moral agents use rational emotions, such as compassion which is our focus here, to imaginatively reconstruct others’ thoughts, feelings and goals. In turn, this imaginative reconstruction plays a crucial role in deliberating and discerning how to act. A body of literature has developed in support of the role narrative artworks (i.e. novels and films) can play in allowing us (...)

It is on these grounds I defend arts education as compulsory across the curriculum. In (...)

The Affect of good artworks can be difficult to explain or describe, particularly in relation to conceptual art. The experiential process of engaging with an artwork involves the spectator perceiving the physical art object as well as receiving a concept. For an aesthetic experience to result, or for the viewer to be affected, the artist must be skilled and the receiver must adopt the relevant attitude. Many theorists argue that the correct attitude to adopt is one that is objective and (...)

Where is the place for the thinking viewer in the cinema?Laura D'Olimpio - unknown
Much of the current philosophy of film literature follows Walter Benjamin’s optimistic account and sees film as a vehicle for screening philosophical thought experiments, and offering new perspectives on issues that have relevance to everyday life. If these kinds of films allow for philosophical thinking, then they are like other so-called ‘high’ artworks in that they encourage social, political and economic critique of social norms. Yet, most popular films that are digested in large quantities are not of a high aesthetic (...)

Trust, understood as a virtue, incorporates appropriate rational emotional dispositions such as compassion as well as action that is contextual, situated in a time and place. We judge responses as appropriate and characters as trustworthy or untrustworthy based on these factors. To be considered worthy of trust, as an individual or an institution, one must do the right thing at the right time for the (...)

The Mātṛkā Dance: Conceptualizing the Dancing Body of the Goddess.Ana Laura Funes Maderey - forthcoming - Sophia:1-16.
Conceptualizing the image of a dancing Supreme Goddess in the Hindu tradition presents a philosophical challenge because it demands a coherent rational reconciliation between her nature as continuously changing into multiple forms and the realm of pure, absolute, never-changing, formless being. Different strategies have been proposed in the history of philosophy in India. This paper analyzes the image of the dancing Goddess as it appears in the Devī Māhātmya and in the Tantric iconography of the Goddess Kālī. An argument is (...)

    The spaciousness of self-awareness: A phenomenological account of self-reflexivity in Patañjali´s Yoga philosophy.Ana Laura Funes Maderey - 2020 - Asian Philosophy 30 (4):295-306.
Like many other discussions regarding the nature of self-awareness in Classical Indian philosophical traditions, the commentators of Patañjali’s Yogaśāstra deployed the metaphor of light or luminosity to defend the position that consciousness is self-reflexive. In this paper I discuss the way the commentarial tradition of Classical Yoga misinterpreted Patañjali’s notion of self-reflexivity and articulate his account of self-awareness based on Vyāsa’s preferred metaphor of space (ākāśa). I also show how Patañjali´s notion of self-awareness could be understood in terms of “spaciousness” (...)

  46. Thoughts on Film: Critically engaging with both Adorno and Benjamin.Laura D'Olimpio - 2016 - Educational Philosophy and Theory 48 (6):622-637.
There is a traditional debate in analytic aesthetics that surrounds the classification of film as Art. While much philosophy devoted to considering film has now moved beyond this debate and accepts film as a mass art, a sub-category of Art proper, it is worth re-considering the criticism of film pre-Deleuze. Much of the criticism of film as pseudo-art is expressed in moral terms. T. W. Adorno, for example, critiques film as ‘mass-cult’; mass produced culture which presents a ‘flattened’ version of (...)

Latin America is one of the most unequal continents in the world. This inequality translates into marked limitations in the possibilities of having a decent life for a high percentage of the population. Within the groups that are affected, women are undoubtedly even more so, because, in addition to shared economic and social inequalities with other vulnerable groups, they face discrimination based on gender. In Latin America, political protest has been undertaken by women who wish to denounce and abate the (...)
